By creating an account or using ExamNow, you confirm that you have read, understood, and agree to these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use the service.
Use of Service
ExamNow is an AI-powered exam management platform designed for teachers and educational institutions. You may use it only for lawful educational purposes. You must not misuse the platform, attempt to reverse-engineer it, or use it to distribute harmful or unlawful content.
Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@exam-now.com if you suspect unauthorised access to your account.
Student Data
When you add students to the platform, you confirm that you have the necessary authority or consent to do so under applicable laws (such as FERPA or GDPR). You remain the data controller for student data you upload, and we process it on your behalf as a data processor.
Intellectual Property
All content, features, and technology within ExamNow (including our AI models, design, and code) are owned by ExamNow and protected by intellectual property laws. You retain ownership of exam content and questions you create using the platform.
Limitation of Liability
ExamNow is provided on an 'as is' basis. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
Termination
You may cancel your account at any time from your billing settings. We reserve the right to suspend or terminate accounts that violate these Terms & Conditions. Upon termination, your right to use the service ceases immediately.
Governing Law
These Terms & Conditions are governed by and construed in accordance with applicable laws. Any disputes will be resolved through binding arbitration or in the courts of competent jurisdiction, as appropriate.
